Terms of Service
These Terms of Service ("Terms") are a contract between Berg Wind LLC ("we", "us") and you, the user of the Cue mobile application (the "App"). By installing or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. What the App is
Cue is an educational tool that helps a male partner understand and support his partner's menstrual cycle. It provides cycle predictions, educational articles, daily logging, and intimacy guidance.
Cue is not a medical device. It is not a contraceptive method. It is not a substitute for advice from a qualified healthcare professional. Cycle predictions are estimates and may be inaccurate, especially during stress, illness, hormonal changes, perimenopause, or other factors. Use reliable contraception if you are not trying to conceive. You acknowledge that you understand these limits before using the App.
2. Your responsibilities
You agree to:
- Use the App only for lawful purposes
- Not log data about another person without their knowledge and consent
- Be 17 years or older
- Not attempt to reverse-engineer, decompile, or modify the App
- Not use the App in a way that violates Apple's App Store or Google Play's terms
3. Subscriptions
3.1 Free vs Pro
Some features are available for free. Pro features (full article library, advanced insights, conception mode, etc.) require an active subscription. The split between free and Pro is shown in the App.
3.2 Trial
We may offer a free trial of Pro. During the trial you have full Pro access. If you do not cancel before the trial ends, the subscription automatically converts to a paid plan and you will be charged.
3.3 Billing
Subscriptions are billed through Apple App Store or Google Play, not by us directly. Pricing is shown at the point of purchase. Subscriptions auto-renew at the end of each billing period unless you cancel at least 24 hours before the renewal date through your App Store or Google Play account settings.
3.4 Refunds
Refund requests are handled by Apple or Google according to their own policies — we cannot issue refunds directly. To request a refund, contact Apple Support (for iOS) or Google Play Support (for Android).
3.5 Price changes
We may change subscription prices. We will notify you in the App before a price change applies to you. If you do not agree, cancel before the next renewal.
4. Intellectual property
The App, all educational content, designs, logos, copy, and the trade name "Cue" are owned by Berg Wind LLC. You may use the App for personal, non-commercial purposes. You may not republish article text, screenshots, or any portion of the App without written permission.
5. Disclaimers
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:
- Predictions or insights will be accurate
- The App will be uninterrupted, error-free, or available
- The App will meet your specific needs
You use the App at your own risk. Do not rely on the App for contraception, conception planning, or any medical decision without confirming with a healthcare professional.
6. Limitation of liability
To the maximum extent permitted by law, Berg Wind LLC and its affiliates are not liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of data, profits, or use, arising from your use of the App — including but not limited to unintended pregnancy, contraceptive failure, missed medical conditions, relationship outcomes, or emotional distress.
Our total liability to you for any claim arising from these Terms or your use of the App is limited to the amount you paid us in the twelve months preceding the claim, or USD $50, whichever is greater. Some jurisdictions do not allow limitation of liability — in those jurisdictions, the limit applies to the maximum extent allowed.
7. Indemnification
You agree to indemnify and hold harmless Berg Wind LLC from any claim or demand arising from your misuse of the App, your breach of these Terms, or your violation of any third party's rights.
8. Termination
We may suspend or terminate your access to the App if you violate these Terms. You may terminate at any time by uninstalling the App and cancelling any active subscription through Apple App Store or Google Play.
9. Changes to these Terms
We may update these Terms. Material changes will be announced in the App. Continued use of the App after changes take effect constitutes acceptance.
10. Governing law
These Terms are governed by the laws of the State of [STATE OF FORMATION], United States (the state in which Berg Wind LLC is registered), without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in [STATE OF FORMATION], unless you have a non-waivable right to bring suit in another jurisdiction (e.g. consumer-protection rules in your home country).
